Historical Development
The Supreme People's Procuracy of Lao People's Democratic Republic traces its origins from post-1975, moving through key reform phases in 1990, 2003, 2009, and 2017. It was transformed from a department within the Ministry of Justice to a standalone entity with expanded regional and zoning offices.
Personnel Appointment
The Prosecutor General is tied to the National Assembly cycle and appointed by the President. Prosecutors and administrative staff are appointed by the Prosecutor General.
Organizational Structure
(a) Multi-tiered setup: Supreme Office, Regional Offices (North, Central, South), Provincial/Capital Offices, Zoning Offices, and Military Prosecutors.
(b) Internal departments: Criminal, Civil, Inspection, Prisons, International Cooperation, Finance, Institution and Training.
Roles & Responsibilities
The main roles and responsibilities of the Supreme People's Procuracy include the following:
(a) Criminal Investigation and Prosecution: Monitors and inspects the legality of investigations conducted by other agencies. It also has the authority to undertake full or partial investigations itself. A key duty is to ensure that criminal cases are investigated thoroughly and objectively, that offenders are punished according to the law, and that innocent people are not wrongly accused.
(b) Legal Enforcement: Includes powers to prosecute, investigate, reopen cases, and monitor detention facilities.
(c) Court Engagement: Attends hearings, evaluates decisions, and even files appeals.
(d) Inspection and Correction: Ensures enforcement of judgments and proper treatment of detained individuals.
(e) Policy Recommendations: Identifies systemic issues and suggests reforms.
